The claims adjusters or managers of insurance companies use tactics and methods in order to limit the payouts, or even deny it entirely. The legal team of the insurance company can also intervene if a case is brought to court. This means that no matter what happens, if you speak with the other driver’s insurance company, you can be sure you’ll be dealing with people whose goal is to minimize claims in any legal way possible. Unarmed and without a lawyer is a terrible idea.
Sometimes clients learn this the hard way. We have seen for example folks come to us after they have given a recorded statement, trying to work with the insurance company themselves. Because they are seeking information that is potentially harmful to the client but advantageous to the defendant and insurance company, this is why. This is particularly true in the light of contributory neglect. Conversing with insurance providers can lead to misunderstandings. They aren’t trying to protect you. Instead, they are playing a game in which they try to get out from paying you the amount of your claim.
Common Case Types
Although the Texas Department of Transportation has no data on rear-end traffic accidents, we know they are approximately 28% or 29% nationally. This type of accident is most likely the most common in the country and Texas is no exception.
Texas is a modified comparative fault state, which means that rear-end accidents in Texas are not solely attributed to the person who caused them. It is important to consider the potential contributing factors. Did you have your brake lights on at all? Did you slow down traffic? You used turn signals. Then, the finding of fact must be made in these cases: Was the defendant’s vehicle behind you? Because your testimony can be refuted, there must be other evidence to prove the defendant followed too closely.
Rear-end collisions could occur for several reasons. Sometimes there are unseen circumstances or conditions that cause it. For example, an object in the roadway might have caused the defendant to stop suddenly causing his/her vehicle to run into you. In some cases, the defendant may have been following you too closely, and ran up on your bumper before hitting you.
In court, both sides of an aisle will ask questions. For example, what can be said about weather conditions? Did they contribute to cause this collision? What about speeding? There might even be an argument about whether or not your tail lights were working. Last but not least, there’s the matter of contributory negligence. Some may argue that you contributed the collision by not stopping for traffic ahead.
Rear-ending is not an automatic win for a claimant, as you can see. It is a great idea to consult an experienced attorney who specializes in auto accident cases.
Although head-on crashes occur less frequently than rear-end accidents, they can be statistically more serious. According to the Texas Department of Transportation, 538 people died in head-on collision accidents in 2020. These accidents constituted almost 14% of the traffic fatalities for the year in Texas.
Distracted Driving Accidents
The distractions caused by personal devices aren’t limited to texting. Texting while driving is illegal in Texas, but it is still allowed to use a handheld phone for other purposes such as GPS or music. It does not necessarily mean that someone who causes an accident because of distracted driving is exempted from liability if they are doing something other than texting. A Class A misdemeanor can result in a sentence of up to one year in jail and as much as $4,000 in fines.
In addition to state laws, individual cities in the Dallas / Fort Worth area have created ordinances to varying degrees, some more strict than the state laws.
Distracted driving is the cause of 368 traffic fatalities in 2020, regardless if there are any laws. There were many more who could have been involved in non-fatal crashes or contributed to them.
Texas recorded 1,354 fatalities from single-car accidents in 2020. These are referred to by NHTSA as “ROR” – Run-Off Road Crashes.
ROR crashes most often involve one party. This includes factors like alcohol use, poor weather and distracted driving. These cases are not usually handled by personal injury attorneys because they involve only one party.
Some ROR accidents are caused by another driver, requiring you to take evasive actions to avoid a collision. Texas was home to 51% of all fatalities in 2020. These areas typically have two-lane highways with opposing traffic, which can lead to drivers drifting into the oncoming lane. Drivers may also attempt to pass unsafely.
If another driver ran you off of the road, for example someone under the influence of alcohol or drug or someone who fell asleep at work, you will need to provide proof that the other driver caused the accident. If an accident occurred between two cars, the insurance company will examine why. Eye-witnesses may be able to testify if the other driver fled. Drivers are increasingly equipping their cars to have dash cams.

Intersection and Side Impact Collision
Like head-on collision cases, intersection and side impact crashes are a major contributor to serious injury and fatalities in Texas. In 2020, the state had 865 fatalities due to intersection-related accidents.
Side-impact collisions can result in serious injury. There is less impact protection on the side than there is on the front. This type of accident is very dangerous in Texas, despite the fact that modern cars come with side impact airbags, impact pillars, and curtains.
Like other Texas accident types, a broad-side incident can’t be treated as a straightforward case because of modified contributory negligence law. It is possible that, even if the driver was negligent in an accident, their negligence might not be enough to get their car insurance paid out. It is crucial to have a Texas accident lawyer on your side.
Common Mistakes in a Traffic Collision
Parties to an accident may move vehicles without taking photographs or having officers present at the scene. This is a mistake. It makes it difficult to get reliable photographic evidence and also leaves little opportunity for police observation of the vehicles once they are settled.

They’re trying to get information that will help them and their insured. The insured is not required to contact the insurance company.
People make the common mistake of not seeking treatment immediately and believing that they can handle it. They don’t have the documentation required by a doctor to back up their claims. As time passes, the likelihood of getting treatment is greater. The insurance company can then claim that you have not been injured if you don’t seek medical attention immediately or if the wait goes on too long. Insurance companies can also use gaps in treatment to defend their clients.
People can make common errors by not speaking to the at-fault company, making a statement, trying their best to resolve the claim, accepting an earlier settlement without knowing the outcome and not seeking treatment immediately.
Fighting the Insurance Companies
Insurance companies may unjustly accuse the wounded person of causing a collision in an effort to reduce payouts. It is possible that the police report was incorrect and victim-blaming could follow. The negligent driver might cause you to be in a “he said/she said” situation. To win your case, you’ll need compelling evidence and the assistance of a professional.

Insurance for personal injury protection
Personal injury protection (PIP), is a type coverage that is included in many personal auto policies. PIP can be omitted in certain cases, such as Medicare, but for most drivers it is mandatory.
This form of personal auto coverage is designed to pay for any medical bills incurred in an accident. This means you can pay for your own and your passengers’ medical bills regardless of how the case ends. PIP can also pay for lost wages.
The Texas minimum policy limit for PIP is $2,500. This is not much. It’s possible that you would have selected a higher sum if you had a competent agent who explained the coverages to you. This will allow you to pay for short-term medical expenses while the case progresses.
When an Accident Case Is Submitted to the Court
Most insurance claims can be settled without the need to file a suit.
However, not all automobile accidents can be resolved. Perhaps the issues that need to be resolved are beyond the parties’ abilities. Perhaps the plaintiffs and defendants could not agree on how much compensation should be paid because they couldn’t resolve their differences.
Expert witnesses, witnesses, responding law enforcement officers and other witnesses can be called in a trial. The jury will decide the extent (or non-extent) of liability held by the defendant. A trial case is more expensive and takes longer than a settlement. However, a jury could award more damages to a plaintiff than any settlement. Sometimes your attorney may even be able to argue that you be awarded punitive damages which is something that would not be offered in a settlement.
Discovery & Deposition
A deposition is required by the defense side after you file a lawsuit. This is a formal conversation that you will have with the defense side. The court reporter and both attorneys from each side will also be present. Both sides will ask you questions to get more information about the accident, who was negligent, your injuries, damages, and other details. Our attorney will also depose any other drivers to get their side of the story, get insight into what they may say in their testimony at the trial, learn more about the finances and insurance coverage of the defendant, get a feel for the defense strategy of the defendant, and more.

Texas regulations for depositions make it clear that you will not feel intimidated. And your accident lawyer will confirm this.
Texas Motor Vehicle Trial Cases Expert Witnesses
Expert witness can provide their opinions to the jury in court cases. Expert witnesses can offer their expert opinion to assist the hearings in drawing a conclusion, based upon the available information.
The most common example of an expert witness in a motor vehicle accident case are medical experts. These medical experts and doctors can give an opinion on the likelihood of recovery, treatment needs, or prognosis for an injured party.
Expert witnesses can contribute to a stronger case for a claimant, but this is not so every time. Expert witnesses aren’t always called. They typically participate only when requested by the court. When this happens, an experienced motor vehicle firm will have resources to draw upon for finding the right expert witness.
How Long Does a Court Case Take For an Auto Accident?
When determining how long it takes, the trial is not the only factor. Before you can step foot in the courtroom, there are many things that must happen. The lawsuit must be served on the defendant. Each party will then have to exchange evidence and depose witnesses. This whole process can take as much as a year depending on how complex the case is and how many parties are involved.

Don’t know how to begin but foremost thank God for the great thing He has done. Thanks to Jessie for everything she has done for me from the very first day I contacted her. As a real estate investor, I hired the Lonergan firm to assist with a dispute over the title on a property I purchased, that previously had a contract for deed. She was responsive with the consultation and when she needed information from me, but once I furnished what was requested and paid for the services, it was apparent she had little interest in handling my case. I even had to ask point blank to her assistant, “is this a case you even want”, because the responsiveness was so poor. Seeing the responsiveness, he wasn’t sure so he needed to ask as Gaylene well and suggested they may refund my money. They ultimately assured me it was a case they wanted, but in hindsight it clearly was not. She missed several meetings via phone call we had scheduled and took much longer than committed with the initial letter. 8 months later there has been no progress in my case and I am hiring a much better and responsive firm to manage my case. I sent several emails, with no meaningful response to Gaylene and certainly no action in moving my case forward… just an empty “sorry for the delay, we are working on your petition”. Severely disappointed and a total waste of time and money. I would avoid at all cost!

I did not want to write this review but then I felt it is a must that I tell people how Attorney Husein Abdelhadi dealt with my immigration case. I came to him asking him how to get my overseas children a USA citizenship from me being a US citizen. He told me that I need to go through the process of I-130. This took almost 2 years and $15K to get to the embassy. When we went to the embassy, the counselor told me that I should not have done all this. I only need to go to the US citizen section in the embassy to get counselor birth certificates and passports. So I did not have to wait 2 years and spent $15K. I approached him and he denied any misdoing. I approached a law office to sue him but it will cost me over $15K and a lot of time that I do not have. Attorney Husein Abdelhadi is either does not know his immigration laws OR he hid the truth from me dishonestly to make money. In one of the emails he sent me, he threatened me to disclose some personal information I have, do you want to deal with such a person!!!!!???

We reached out to the firm for an immigration question and booked a telephonic meeting. Our call got rescheduled few times. We got a call from the lawyer before the scheduled time because she was available. Responses we got for the lawyer were simply yes and no. We could have find the answers with a simple google search. We were not asked about the background and any relevant details.

They don’t return calls or emails. Calls always go to voicemail like they know we are calling. When we do get in contact with some their excuse is always due to covid. It’s been ongoing for six months now.
