Common Case Types

Rear-end Collisions

Although Texas Department of Transportation does not collect data on the proportion of traffic collisions are rear-end accidents, nationally speaking, we know that they are about 28% or 29%. This type is most likely to be the most prevalent in the nation, and Texas is no exempt.

Texas is a “modified relative fault state” meaning that rear-end crashes do not just point the finger at the driver. You should evaluate mitigating factors. Did you have your brake lights on at all? Are you able to stop traffic flow completely? Were you using turn signals? Then, the finding of fact must be made in these cases: Was the defendant’s vehicle behind you? Because your testimony can be refuted, there must be other evidence to prove the defendant followed too closely.

There are a few reasons rear-end collisions can occur. It can sometimes be caused by circumstances or circumstances that are not known. You might be able to see an object on the roadway that caused the defendant’s vehicle suddenly to stop. Sometimes, the defendant may have been following too closely before running up to your bumper and then ramming into you.

In court, both sides of an aisle will ask questions. Weather conditions are one example. Did they contribute to cause this collision? What about speeding? There might even be an argument about whether or not your tail lights were working. Last but not least, there’s the matter of contributory negligence. You might be argued that you contributed to the accident if you did not lane brake ahead of traffic.

Rear-ending is not an automatic win for a claimant, as you can see. These issues can be complicated and a skilled auto accident lawyer is your best friend.

Head-on Collisions

While head-on accidents are less common than rear end accidents, they are statistically much more dangerous. The Texas Department of Transportation recorded 538 fatalities from head-on collisions in 2020. These accidents were responsible for nearly 14% of all traffic fatalities in Texas.

Distracted Driving Accidents

These days, the distractions from personal devices is not limited to just texting. While Texas has outlawed texting while driving since 2017, it is still permissible to use a handheld device for other things such as using GPS or playing music. Distracted driving can still be a cause of an accident. However, it does not mean that a driver who causes an accident through distracted driving is excused just because they were texting. However, the law allows for a Class A Misdemeanor to be filed. This can include a one-year sentence and a maximum $4,000 fine.

Out of state laws, each city in the Dallas/Fort Worth metro area has its own ordinances. Some may be more strict than those created by the state.

Regardless the laws, in 2020 368 traffic accident fatalities were attributed to distracted driving. Hundreds more were likely involved in or contributed to non-fatal accidents.

Run-off-road collision

Texas recorded 1,354 fatalities from single-car accidents in 2020. The NHTSA refers to these as “ROR” or Run-Off-Road crashes.

ROR crashes most often involve one party. This includes factors like alcohol use, poor weather and distracted driving. Because most of these accidents occur due to the fault of the single party, these cases are not as commonly handled in personal injury law firms.

ROR collisions can also be caused by another driver. In these cases, you will need to take evasive measures to avoid a collision. Texas was home to 51% of all fatalities in 2020. These areas typically have two-lane highways with opposing traffic, which can lead to drivers drifting into the oncoming lane. Other times, drivers may try to pass unintentionally.

If another driver ran you off of the road, for example someone under the influence of alcohol or drug or someone who fell asleep at work, you will need to provide proof that the other driver caused the accident. If you allege that the accident was caused or contributed to by another driver, an insurance company will review your claim. Eyewitnesses might be able to give testimony if another driver fled the scene. More and more drivers are also equipping their cars with dash cams.

Common Mistakes following a traffic collision

Parties to an accident often move the vehicles involved in the collision without taking photos or having police on the scene. This is a mistake as it prevents photographic evidence from being as dependable and misses the chance for police observation of the vehicles as they were immediately upon settling from the collision.

People make another common error when they contact their at-fault insurance company and give a recorded statement. Many people think they’re being cooperative. They aren’t being looked out for by their insurance company. They’re trying to get information that will help them and their insured. The insured is free to not speak with the insurance company.

People make the common mistake of not seeking treatment immediately and believing that they can handle it. They don’t have documentation from a professional to support their claims. There is more time between getting treated and not getting it. If you wait too much or don’t seek medical attention right away, the insurance company can claim that your injuries aren’t sustained. An insurance carrier may also use a gap between treatment as a defense.

People can make common errors by not speaking to the at-fault company, making a statement, trying their best to resolve the claim, accepting an earlier settlement without knowing the outcome and not seeking treatment immediately.

Stopping Insurance Companies

Insurance companies may unjustly accuse the wounded person of causing a collision in an effort to reduce payouts. It’s possible that the police report is incorrect. Victim-blaming can follow. Personal injury coverage (PIP) can be included on most personal auto policies. Although you can opt out of PIP in some cases such as if you have Medicare, for most drivers, the coverage is mandatory.

This means that regardless of the outcome of the case involving the other driver’s liability, you can still get medical care for yourself and your passengers. PIP may also be used to pay lost wages.

That said, the minimum required policy limit for PIP in Texas is only $2,500 – not a whole lot. You may have selected a higher amount if your agent was knowledgeable and had reviewed all the coverages. This will be useful to cover medical expenses for the short term while your case is developing.

The moment an Accident Case is taken to Court

Most insurance claims settle before a lawsuit is filed.

However, not all accidents involving vehicles can be solved. Perhaps the issues that need to be resolved are beyond the parties’ abilities. Perhaps the plaintiffs and defendants could not agree on how much compensation should be paid because they couldn’t resolve their differences.

Expert witnesses, witnesses, responding law enforcement officers and other witnesses can be called in a trial. The jury will decide on the defendant’s extent of liability. Although a trial case may take more time and money than a settled claim, a jury might be able to award a plaintiff higher than any settlement. Sometimes your attorney may even be able to argue that you be awarded punitive damages which is something that would not be offered in a settlement.

Discovery & Deposition

The defense side will request a deposition after you have filed a lawsuit. This is a formal conversation where you will be sworn in. Each side’s lawyers will be present, as will a court reporter. Each side will ask you questions about the accident and who was responsible, as well as your injuries and damages. Here’s where Susan and Kuerstin at Texas Title SAVE THE DAY… Literally 48 hours before we were supposed to close with this other company, we find out they have done NOTHING (then later in the day send they send a fraudulent wire transfer). In a panic, I call Susan since they did a good job when we close our old home with them. Susan tells me if we get everything we need ASAP, we can close in a week. That’s fantastic news since we are having to start from zero. Long story short, Susan expedites all of our documents, works well with our mortgage guy, and is able to get us to close in SIX business days.

These people are LIFE SAVERS! We sort of randomly picked them as our title office primarily based on location (they were close to us). After all, its “just the title office; all they do is file the paperwork, right?” So we sold our home and closed on time, no issues, as expected. Boring transaction.

I have had the good fortune to have worked with Geni Manning for the last two years and during this time I have witnessed firsthand her tenacity and perseverance in getting a client’s home sold or in working through issues with a buyer. I could relate many situations but one in particular that I will not forget is a short-sale that involved a divorce, bankruptcy and foreclosure. As if things weren’t complicated enough, the husband was totally uncooperative and uncommunicative.
